On May 20, 2016, 101133330 Saskatchewan Ltd. and 101149825 Saskatchewan Ltd. (collectively the “Applicants”) filed an application in the Court of Queen’s Bench for Saskatchewan (the “Court”) and commenced Court supervised restructuring proceedings under the Companies’ Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended (the “CCAA”).

On the same day, the Court granted an order (the “Initial Order”), which, among other things, provided for a stay of proceedings (the “Stay Period”) which prohibited all parties from commencing or continuing any legal action against the Applicants, and all rights and remedies of any party against or in respect of the Applicants or their assets were stayed and suspended except with the written consent of the Applicants and the Monitor, or leave of the Court.

Since the granting of the Initial Order, various extensions of the Stay Period have been granted by the Court, with the most recent Stay Period expiring on July 5, 2019.

As a term of the Initial Order, Deloitte Restructuring Inc. was appointed as Monitor (the “Monitor”) in the CCAA proceedings to oversee the operations of the Applicants during the restructuring.

On May 27, 2019, the Court granted an Order approving the termination of the CCAA proceedings in respect of 101149825 Saskatchewan Ltd., and accordingly discharged the Monitor.  On June 26, 2019, the Court granted an Order approving the termination of the CCAA proceedings in respect of 101133330 Saskatchewan Ltd., and accordingly discharged the Monitor, subject to the Monitor’s filing of the Monitor’s Discharge CertificateThe Monitor filed the Monitor’s Discharge Certificate with the Court on August 9, 2019.

As a result of the termination of the CCAA proceedings, there is no longer a stay of proceedings in place as against the Applicants. 

As the CCAA proceedings have come to an end, and the Applicants will not be filing a plan of arrangement, creditors are not required to file a proof of claim.
