On August 16, 2017, Tri State Signature Homes Ltd. (the "Company") filed a Notice of Intention to Make a Proposal (the "NOI") under section 50.4(1) of the Bankruptcy and Insolvency Act (the "BIA"). Deloitte Restructuring Inc. ("Deloitte" or the "Trustee") consented to act as Licensed Insolvency Trustee under the NOI.
The Company's proposal was refused by creditors at the reconvened meeting of creditors held on October 11, 2018, and the Company was thereupon deemed to have made a bankruptcy assignment. Deloitte was appointed Licensed Insolvency Trustee for the bankrupt estate.
The Trustee is gathering information regarding the Company's affairs and is not currently in a position to return deposits. Homeowners may provide their contact information, the quantum of and nature of their claim by completing a proof of claim in the prescribed form and submitting it to the Trustee.
The Company is no longer operating and will not be able to complete warranty work. Homeowners may wish to consult the Alberta New Home Warranty Program to inquire about any available recourse.
The meeting of creditors is to be reconvened on November 14, 2018. The Trustee will be preserving the assets of the bankruptcy estate until the reconvened meeting.
