On September 29, 2015, Harvest Mustang GP. Ltd., Harvest Ontario Partners Limited Partnership and Harvest Power Mustang Generation (collectively, the “Debtors”) filed a Notice of Intention to Make a Proposal with the Office of the Superintendent of Bankruptcy under Section 50.4(1) of the Bankruptcy and Insolvency Act (Canada). (“NOI”). Deloitte Restructuring Inc. was named as Proposal Trustee.

The NOI among other things, provides for a stay of proceedings and the Debtors must file a proposal to their creditors within a 30-day period following the filing of the NOI or within any extension granted by the Court.

The Companies did not file a proposal by January 8, 2016 and therefore the Companies were deemed bankrupt. The assets of the Companies were sold and vested by Order of the Ontario Superior Court in December 2015. The Companies have no assets. The first meeting of creditors for the Companies are on January 28, 2016 at 11:00 a.m. in London, Ontario.
