On August 16, 2017, Trend Aurora Ltd. (the "Company") filed a Notice of Intention to Make a Proposal (the "NOI") under section 50.4(1) of the Bankruptcy and Insolvency Act (the "BIA"). Deloitte Restructuring Inc. ("Deloitte" or the "Trustee") consented to act as Licensed Insolvency Trustee under the NOI.The Company's proposal was refused by creditors at the reconvened meeting of creditors held on October 11, 2018, and the Company was thereupon deemed to have made a bankruptcy assignment. Deloitte was appointed Licensed Insolvency Trustee for the bankrupt estate.Information for homeowners with outstanding deposits and/or warranty work:The Trustee is gathering preliminary information to determine the priorities of creditor claims on deposits and holdbacks. As such, the Trustee is not in a position to return monies at this time. Homeowners may provide their contact information, the quantum of and nature of their claim by completing a proof of claim in the prescribed form and submitting it to the Trustee. The Company is no longer operating and will not be able to complete warranty work. Homeowners may wish to consult the Alberta New Home Warranty Program to inquire about any available recourse.
On February 1, 2021, the Trustee was discharged from the bankruptcy estate.
