​March 1st, 2017 - Take notice that BCBG MAX AZRIA CANADA INC. has filed a Notice of Intention to make a Proposal to its creditors, a copy of which is attached, and that we have consented to act as trustee.

On March 29, 2017, BCBG Max Azria Inc., filed a petition for an extension of delay in accordance with the Section 50.4 paragraph 9 of the Bankruptcy and Insolvency Act. Said petition was granted, thereby having the effect of prolonging the delay in which to file the proposal by an additional forty-five (45) days, until May 15, 2017

On May 12, 2017, BCBG Max Azria Inc., filed a petition for a second extension of delay in accordance with the Section 50.4 paragraph 9 of the Bankruptcy and Insolvency Act. Said petition was granted, thereby having the effect of prolonging the delay in which to file the proposal by an additional forty-five (45) days, until June 29, 2017.

On June 28, 2017, BCBG Max Azria Inc., filed a petition for a third extension of delay in accordance with the Section 50.4 paragraph 9 of the Bankruptcy and Insolvency Act. Said petition was granted, thereby having the effect of prolonging the delay in which to file the proposal by an additional forty-five (45) days, until August 11, 2017.

On July 20, 2017, BCBG Max Azria Inc., filed a petition for a fourth extension of delay in accordance with the Section 50.4 paragraph 9 of the Bankruptcy and Insolvency Act. Said petition was granted until August 11, 2017, thereby having the effect of prolonging the delay in which to file the proposal by an additional twenty (20) days, until August 31, 2017.

On July 25, 2017, following the Application for an approval, vesting, assignment and for extension of time to file a Proposal, an Order was rendered by the Court approving the sale, vesting, agreement and extension order.

On September 1, 2017, BCBG Max Azria Canada Inc. was deemed to have filed an assignment, as per the Report of Trustee on non-filling of Proposal, dated September 1, 2017.

The first meeting of creditors of the Bankrupt was held on the 20th day of September at 9:30 a.m., at the office of the Trustee located at 1190 Avenue des Canadiens-de-Montreal (La Tour Deloitte), Suite 500, Room 5-024, Montreal, Quebec H3B 0M7, as per the Notice of Bankruptcy and First Meeting of Creditors, dated September 7, 2017.
