November 29, 2013 - NOTICE is hereby given that IHG HARILELA HOTELS LTD. has filed on November 29, 2013 a Notice of Intention to Make a Proposal to its creditors, a copy of which is attached, and that we have consented to act as trustee.
A copy of the proposal will be forwarded to all creditors before the holding of the first meeting of creditors, which should be held on a date and at a place to be determined.
On December 27, 2013, IHG HARILELA HOTELS LTD., filed a petition for an extension of delay in accordance with Section 50.4 paragraph 9 of the Bankruptcy and Insolvency Act. Said petition was granted, thereby having the effect of prolonging the delay in which to file the proposal by an additional forty-five (45) days, until February 10, 2014.
On February 7, 2014, IHG HARILELA HOTELS LTD., filed a second petition for an extension of delay in accordance with Section 50.4 paragraph 9 of the Bankruptcy and Insolvency Act. Said petition was granted, thereby having the effect of prolonging the delay in which to file the proposal by an additional forty-five (45) days, until March 24, 2014.
On March 21, 2014, IHG HARILELA HOTELS LTD., filed a third petition for an extension of delay in accordance with Section 50.4 paragraph 9 of the Bankruptcy and Insolvency Act. Said petition was granted, thereby having the effect of prolonging the delay in which to file the proposal by an additional forty-five (45) days, until May 8, 2014.
On May 5, 2014, IHG HARILELA HOTELS LTD., filed a final and fourth petition for an extension of delay in accordance with Section 50.4 paragraph 9 of the Bankruptcy and Insolvency Act. Said petition was granted, thereby having the effect of prolonging the delay in which to file the proposal by an additional twenty (20) days, until May 28, 2014.
On May 27, 2014 , IHG HARILELA HOTELS LTD., lodged with Samson Bélair/Deloitte & Touche Inc, a proposal under the Bankruptcy and Insolvency Act.
On June 13, 2014, Samson Bélair/Deloitte & Touche Inc., became the receiver in respect of all movable and immovable property of IHG HARILELA HOTELS LTD.
The first meeting of creditors to vote on the Proposal filed by IHG Harilela Hotels Ltd. was held on June 17, 2014. The meeting was adjourned to September 2, 2014 at 10:00 a.m.
The adjourned first meeting of creditors to vote on the Proposal filed by IHG Harilela Hotels Ltd. was held on September 2, 2014. The meeting was adjourned to September 30, 2014 at 10:00 a.m.
The adjourned first meeting of creditors to vote on the Proposal filed by IHG Harilela Hotels Ltd. was held on September 30, 2014. The meeting was further adjourned to October 27, 2014 at 10:00 a.m.
Take notice that, at the October 27, 2014 meeting, it was unanimously resolved that the meeting to vote for the acceptance or the refusal of the proposal be adjourned again to Friday, December 5, 2014 at 10:00 a.m., at the office of the Superintendent of Bankruptcy located at 1155 Metcalfe Street, Room 1071 (Sun Life Building), Montreal, Quebec H3B 2V6.
The adjourned first meeting of creditors to vote on the Proposal filed by IHG Harilela Hotels Ltd. was held on December 5, 2014 at 10:00 a.m. The meeting was further adjourned to February 27, 2015 at 10:00 a.m. , at the office of the Superintendent of Bankruptcy located at 1155 Metcalfe Street, Room 1071 (Sun Life Building), Montreal, Quebec H3B 2V6.
Take notice that, an Amended Proposal was presented at the February 27, 2015 meeting, and was approved by the creditors.
A Motion for Approval and Homologation of a Proposal was presented to the Court on March 30, 2015, and on the same day the Court rendered the Order for the approval of the Proposal
