On March 11th, 2019 the Ontario Superior Court of Justice (Commercial List) issued an Order (the "Appointment Order") pursuant to section 243(1) of the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3, as amended (the "BIA") and section 101 of the Courts of Justice Act, R.S.O. 1990, c. C.43, as amended, appointing Deloitte Restructuring Inc. as receiver (in such capacities, the "Receiver") without security, of all of the assets, undertakings and properties of Distinct Infrastructure Group Inc. including its subsidiaries iVac Services West Inc., Distinct Infrastructure Group West Inc., QE2 Holding Corp., iVac Services., DistinctTech Inc., Crown Utilities Ltd., Distinct Environmental Solutions Inc. (together, the "Debtors"), acquired for, or used in relation to a business carried on by the Debtors.
The March 11, 2019, Order appointing the Receiver permitted the Receiver to make an assignment in bankruptcy on behalf of any or all of the Debtors. The Receiver filed an assignment in bankruptcy for DistinctTech Inc. and the Office of the Superintendent of Bankruptcy issued a Certificate of Appointment of Deloitte Restructuring Inc. as trustee in bankruptcy of DistinctTech Inc. on March 22, 2019.
