On July 8, 2014, Metcalfe & Mansfield Alternative Investment VII Corp. (the “Applicant”), in its capacity as Issuer Trustee of Devonshire Trust, (collectively with the Applicant, the "CCAA Parties") sought and obtained an Initial Order pursuant to the Companies’ Creditors Arrangement Act (“CCAA”) from the Ontario Superior Court (Commercial List) (the “Court”). The Court has appointed Deloitte Restructuring Inc. as monitor (the “Monitor”) of the CCAA Parties. The Plan has been sanctioned on August 20, 2014. The Plan implementation occurred on September 15, 2014 and on the same date the Monitor has proceeded with the Initial Distribution to Noteholders.
