​​​On June 11, 2020, Swimco Aquatic Supplies Ltd. and Swimco Partnership  (the "Companies") each filed a Notice of Intention to Make a Proposal (the "NOIs") pursuant to Section 50.4(1) of the Bankruptcy and Insolvency Act (the "BIA"). 

Pursuant to Section 69(1) of the BIA, all proceedings against the Companies are now stayed and service to the Companies cannot be discontinued.

The time period within which the Debtors were required to file a proposal to their creditors was extended to October 9, 2020, pursuant to two Court orders. The Debtors were unable to make a viable proposal to their creditors on or before October 9, 2020 and were thereupon deemed to have made an assignment into bankruptcy effective October 10, 2020. Deloitte Restructuring Inc. was appointed as trustee in bankruptcy of the Debtors' estates.

The first meeting of creditors for Swimco Aquatic Supplies Ltd. will be held on October 30, 2020 at 2:00pm MTN through electronic or digital means of communication. To be entitled to vote at the meeting you must file with us, prior to the meeting, a proof of claim form, and where necessary, a proxy. On November 10, 2020, Deloitte Restructuring Inc. was appointed by the Court of Queen's Bench of Alberta as receiver and manager (the "Receiver") in respect to all the assets and property of Swimco Aquatic Supplies Ltd., Swimco Partnership, Blue Crush Bikini & Boardshort Company Ltd., Lori Bacon Holdings Ltd., and Steve Forseth Holdings Ltd.

The Swimco Partnership first meeting of creditors originally scheduled for October 30, 2020 at 1:00 PM MST has been adjourned pursuant to the certificate of assignment issued by the Official Receiver of the Office of the Superintendent of Bankruptcy, dated October 29, 2020. The first meeting of creditors for Swimco Partnership, along with Blue Crush Bikini & Boardshort Company Ltd., Lori Bacon Holdings Ltd., and Steve Forseth Holdings Ltd., will now be held on December 3, 2020 at 1:00 PM MST. On April 4, 2023, Deloitte Restructuring Inc. obtained its discharge as Trustee of Blue Crush Bikini & Boardshort Company Ltd., Lori Bacon Holdings Ltd., and Steve Forseth Holdings Ltd.

On October 31, 2024, Deloitte Restructuring Inc. obtained its discharge as Trustee of Swimco Partnership and Swimco Aquatic Supplies Ltd.​
