Receivership Proceedings

On January 19, 2024, Deloitte Restructuring Inc. (“Deloitte") was appointed by an Order of the Court of King's Bench of Alberta (the "Court") as receiver-manager (the “Receiver") without security, of the property of CatalX CTS Ltd., operating as Catalx (“Catalx") and Catalx Management Ltd. including, without limitation, all of the Catalx' current and future assets, undertakings, and properties of every nature and kind whatsoever, and wherever situate, including all proceeds thereof.

The Receiver has realized on all assets of Catalx and anticipates obtaining its discharge on or around June 20, 2025.

Proposal Proceedings

On May 14, 2025, Catalx filed a proposal (the “Proposal") pursuant to the provisions of Part III Division I of the Bankruptcy and Insolvency Act, RSC 1985, c B-3 as amended (the “BIA").  Deloitte, a Licensed Insolvency Trustee (the “Proposal Trustee"), has consented to act, and was appointed as Proposal Trustee in the BIA Proposal proceedings for Catalx.

The First Meeting of Creditors (the “FMOC") was held on June 2, 2025 at 2:00 PM (MST) and was presided over by the Office of the Superintendent of Bankruptcy. At the FMOC, the Proposal was accepted by the required majority of creditors.

An application will be made to the court at the Calgary Courts Centre, 601 5th Street SW Calgary AB T2P 5P7, on the 20th day of June, 2025, at 2:00 PM (MST) to approve the proposal of CatalX CTS Ltd., accepted by the creditors at a meeting held on the 2nd day of June 2025. This application will be made in person. Please refer to the amended notice below for the link to attend via Webex.

Creditors are required to file a proof of claim to participate in the distribution of funds through the Proposal. For instructions on how to file a proof of claim, please refer to the Creditor Package below.
