​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​Lutheran Ch​urch - Canada,  the Alberta - British Columbia District et. al.​​​​​​​​​

On January 23, 2015, the Lutheran Church – Canada, the Alberta – British Columbia District (the "District") and the related entities Lutheran Church – Canada, the Alberta – British Columbia District Investments Ltd., Encharis Community and Housing Services and Encharis Management and Support Services (collectively the "District Group") obtained an initial order from the Court of Queen's Bench of Alberta under the Companies' Creditors Arrangement Act (Canada) (the "CCAA").  The Initial Order provides for a stay of proceeding until February 20, 2015 (the "Stay"), pursuant to which  creditors are restrained from enforcing or exercising any rights or remedies against the District Group.   The Stay has now been extended until September 30, 2016.

The following is the status of each of the Plans of Compromise and Arrangement (the "Plans") filed by the District Group:

1. The Plans for each of ECHS and EMSS were approved by the Court on January 20, 2016;
2. The Plan for DIL was approved the creditors at a meeting held on January 23, 2016 and was sanctioned by the Court on August 2, 2016.  Please see the below update dated August 2, 2016; and
3. The Plan for District was approved by the creditors at a meeting held on May 14, 2016 and June 10, 2016 and was sanctioned by the Court on August 2, 2016.  Please see the below update dated August 2, 2016. 

(No appeal was filed in respect to the Plan for DIL or the Plan for District.  As such, both the Plan for DIL and the Plan for District are now being implemented.)

Deloitte Restructuring Inc. was appointed by the Court as the Monitor in the CCAA process.  The Monitor's duties are set out in the Initial Order and include the following:

• Monitoring the District Group's operations and cash flow during the CCAA proceedings;
• Reporting to the Court as to the District Group's restructuring efforts and compliance with the Initial Order;
• Advising the Court and the  creditors as to the reasonableness and fairness of any Plan that may be proposed by the District Group to its creditors; and
• Overseeing the claims process and reviewing creditor's proofs of claim.​ 

As discussed in the Thirty-Third Report of the Monitor dated November 30, 2017 (the "Thirty-Third Report"), the District was intending to make a further cash distribution to creditors of the District by December 31, 2017 (the "District Distribution").   The release of the District Distribution was contingent on the FLC Settlement (as defined in the Thirty-Third Report) being completed.  The FLC Settlement was contingent on the receipt by the District of an executed Access Road Agreement (also as defined in the Thirty-Third Report) from the City of Calgary.  As a result of a delay in the City of Calgary providing the Access Road Agreement, the District now anticipates that the FLC Settlement will be completed in late December 2017 or early January 2018 with the District Distribution being released shortly thereafter.  Once the District Distribution has been released, creditors of the District can anticipate receiving correspondence from the Monitor in that regard.
